Information Access Requests  (Law N°20.285)

 

Law N°20.285 regulates the principle of probity and transparency of public acts, the right to access information of State Administration entities, the procedures for the exercise of rights and for its defense, and the exceptions to the publicity of information.

By Public Information it should be understood, the acts and resolutions of the State Administration entities, as well as the information elaborated with public budget and all other information which are filed before the State entities, whichever is its format, support, date of initiation, origin, classification or procedure, except those subject to the exceptions indicated by law. 

The exceptions to the rule, that all information is public, refer to five situations in which information shall be considered secret or confidential:

1. When its publicity, communication or knowledge affects the proper fulfillment of the functions of the required State Entity. For  example: when it involves the prosecution and investigation of a crime, when it involves records complied prior to the undertaking of a resolution or general records or those that require distracting officers from complying with their regular duties.

2. When its publicity, communication or knowledge affects the rights of individuals, particularly, when it refers to their safety, health, private life, commercial or economic rights.

3. Whenever its advertising, communication or knowledge affects the safety of the Nation, especially if it refers to the national defense or the support of public order or public security.

4. Whenever their advertising, communication or knowledge affects national interests, particularly, if it refers to public health or to international relations and economic or commercial interests of the country.

5. When a qualified quorum law has declared certain information reserved, or secret.

In reference to the previous paragraph, you are entitled to request and receive information which is in possession of this Service, in accordance to Law N°20.285.

The formal notification of the response and delivery of the information shall be carried out in accordance to what is indicated by the petitioner in the respective form, via email, certified mail or in person at the Superintendence.

We inform you that the institution is authorized to charge the reproduction expenses of the requested information, that is, the associated costs of the photocopying procedure of a document or any other type of support, where the service must incur in said expenses.
