By means of Circular N°13, of December 30, 2010, the Superintendence of Casinos (SCJ) established a process for claim procedures against the casinos authorized by Act N°19.995.
According to the mentioned procedure, if you deem there is a discrepancy regarding the operation or functioning of the casino and the operation of the games of chance you must submit a claim before the casino, during a maximum period of 15 calendar days following the situation that originates the complaint.
The casino, shall respond to said claim, within a period of 10 working days since the claim is acknowledged.
Please remember that according to the Casino Act, the Superintendence of Casinos shall not regulate concessions of Casinos in Arica, Iquique, Coquimbo, Viña del Mar, Pucón, Puerto Varas and Puerto Natales, until December 31st, 2015. Until this date, the municipalities of the cities of the concession will be in charge of supervision and control of the respective Casinos and their operation.
If you are not satisfied with the response issued by the casino, you may appeal against said response before the Superintendence of Casinos (SCJ), within a period of 20 working days following the date in which the casino´s response was notified.
In order to present said claim you must attach a copy of the response issued by the casino.
In accordance to article 27 of Law Nº 19.880, in reference to administrative procedures that pertain to entities or services of the State Administration, said law establishes a maximum period of 6 months for the processing of the procedure, period that shall being run from the day the form is presented. Said period shall apply to Force Majure or unforeseeable circumstances, when said circumstances are duly qualified by the Superintendence.
